2. Users
Accessing and/or using this website TRASTEROSPLUS.ES bestows the status of USER, who accepts, as of this access and/or use, the General Usage Conditions laid down herein. The aforementioned Conditions shall apply irrespective of any General Contracting Conditions that may be mandatory, if applicable.
3. Website use
TRASTEROSPLUS.ES provides access to a lot of information, services, programmes and data (hereinafter, “the content”) on the Internet belonging to BLUETUBE SL or to its licensees, to whom the USER may have access. The USER assumes responsibility for the use of the website. This responsibility extends to any registrations that may be necessary to access certain services or content.
The USER shall be responsible for supplying truthful and legal information during this registration. As a consequence of this registration, the USER may be provided with a password, for which it shall be responsible, and the USER undertakes to make diligent and confidential use thereof. The USER undertakes to make adequate use of the content and services (such as chat services, discussion forums or newsgroups) that TRASTEROS PLUS provides through its portal, and to not use these for activities including, but not limited to:
(i) activities that are illicit, illegal or that go against good faith and public order; (ii) distribute racist, xenophobic, illegal pornographic, terrorism apology or anti-human rights content; (iii) causing damage to the physical or digital systems of TRASTEROS PLUS, of its suppliers or third parties, insert or distribute on the network computer viruses or any other physical or digital systems that may cause the aforementioned damage; (iv) attempt to access and, if applicable, use the email accounts of other users and modify or manipulate their messages.
TRASTEROS PLUS reserves the right to remove any comments and contributions that violate respect for personal dignity, that are discriminatory, xenophobic, racist, pornographic or that infringe upon children or young people, public order or security or that, in its judgement, are not suitable for publication. In any case, Company name that created the website will not be responsible for opinions expressed by users through forums, chats or other participation tools.
4. Data protection
TRASTEROS PLUS complies with the directives of Organic Law 15/1999, of 13 December on Personal Data Protection, Royal Decree 1720/2007, of 21 December, which approves the Regulation implementing the Organic Law, and all other legislation in force at any given time, and guarantees that the user’s personal data are used and processed correctly. For this purpose, each personal data collection form for services that the user may request from TRASTEROS PLUS will inform the user of the existence and acceptance of the particular data processing conditions in each case, and will inform them of the responsibility for the file that is created, the address of the entity responsible, the possibility of exercising their rights to access, rectification, cancellation or opposition, the purpose of the processing and the communication of data to third parties, if applicable.
Similarly, TRASTEROS PLUS hereby states that it complies with Law 34/2002, of 11 July, on Information Society Services and Digital Commerce, and that it will request your consent for the processing of your email address for commercial purposes at all times.
5. Intellectual & Industrial property
TRASTEROS PLUS, either acting on its own behalf or as an assignee, is the owner of all intellectual and industrial property rights of its website, as well as all of the elements contained therein (including images, sound, audio, video, software and texts; brands and logos, combinations of colours, structure and design, selection of materials used, computer programmes required for its operation, access and use, etc.), belonging to TRASTEROS PLUS or to its licensors.

By virtue of the provisions of articles 8 and 32.1, paragraph two, of the Intellectual Property Law, it is expressly forbidden to reproduce, distribute or publicly release, including making available, all or part of the contents of this website, for commercial purpose, in any format and by any technical means, without authorisation from TRASTEROS PLUS.
The USER undertakes to respect the Intellectual and Industrial Property rights belonging to TRASTEROS PLUS. You may view the elements of the website and even print them, copy them and store them on your computer’s hard drive or any other physical media, provided that this is solely and exclusively done for your personal and private use. The USER must refrain from deleting, amending, circumventing or manipulating any protection device or security system that may be installed on the pages of TRASTEROS PLUS.
6. Warranty & liability disclaimer
TRANSTEROS PLUS shall in no case assume liability for any damages or injuries of any nature that may occur, such as: content errors or omissions, lack of availability of the website or the transmission of viruses or malicious or harmful programs in the content, despite having adopted all necessary technological measures to avoid them.
7. Modifications
TRASTEROS PLUS reserves the right to make any modifications to its website that it deems appropriate, and it may change, delete or add the content and services provided through the website, as well as the way in which these are presented or located on its website.

If any links or hyperlinks to other Internet sites are found under the domain name, TRASTEROS PLUS shall not exercise any type of control over the sites and content in question. TRASTEROS PLUS reserves the right to refuse or withdraw access to the website and/or the services that if offers without the need for any advance warning, at its own instance or that of third parties, to any users that fail to comply with these General Conditions for Use.

In the case of a failure to comply with these conditions, as well as in the event of any improper use of its website, TRASTEROS PLUS shall avail itself of all civil and criminal actions available to it by Law.

TRASTEROS PLUS may at any time modify the conditions determined herein, and may duly publish them as they appear herein.
The validity of the aforementioned conditions shall depend on their exposure, and they shall remain in force until amended by other duly published conditions.
12. Applicable legislation & jurisdiction
The relationship between TRASTEROS PLUS and the USER shall be governed by current Spanish law, and any dispute will be submitted to the Courts and Tribunals of the city of Málaga.
